Dueling law professors analyze the Neil Gorsuch confirmation hearing

After two days of often hostile hearings, Supreme Court nominee Neil Gorsuch is proving himself an even-tempered, deeply knowledgeable nominee who should be confirmed by the Senate. “Okay, I’ll criticize judges”, Trump said as the Gorsuch hearing continued.

Judge Gorsuch used the case during his confirmation hearing to argue he would rule for any litigant, no matter who it was.

Unfortunately, some of my colleagues have taken their search for a political judge to new extremes this year.

If the Democrats stand firmly together and oppose Gorsuch, Republicans could reach for the “nuclear option” and change the Senate rules to allow confirmation by a simple majority vote.

The choice of a judge to replace Justice Antonin Scalia, who died in February 2016, has been contentious.
